Huawei sues Zhongxing infringement in Europe

According to foreign reports, Huawei on April 28 in Germany, France and Hungary to ZTE (hereinafter referred to as "ZTE") filed a lawsuit accusing it of infringing Huawei's patent and trademark rights. The contents of the lawsuit include ZTE's infringement of Huawei's series of patents related to data cards and LTE technology, and the unauthorized use of Huawei's registered trademarks on data card products without Huawei's permission.

Huawei’s chief legal officer, Song Liuping, stated that in order to protect Huawei’s innovation achievements and intellectual property rights legally registered in Europe, Huawei had to take this legal action. Huawei's goal is to stop ZTE’s illegal use of Huawei’s intellectual property rights and resolve disputes through negotiations so that Huawei’s technology can be used in a legal manner.

Then the reporter called ZTE relevant person, but as of press time, this person did not give a positive answer. The person emphasized that ZTE always respects intellectual property rights, including its own intellectual property rights and the intellectual property rights of others. According to foreign media reports, ZTE spokesperson Margret Ma has not made any comment on this.

Previously, Huawei had just ended its dispute with Motorola Solutions Corporation. In April, the two parties reached a settlement on all pending lawsuits to enable Nokia Siemens to complete the acquisition of Motorola Solutions.

In early April, ZTE was involved in patent litigation. Ericsson sued ZTE in the United Kingdom, Italy, and other countries for infringement of its 2G and 3G mobile phone technology patents. Ericsson said that the reason for the prosecution was that the negotiation of patent authorization with ZTE had not been successful for a long time. ZTE Corporation subsequently announced that it will actively respond to the lawsuit and counterclaim against patent infringement by Ericsson China Communications Co., Ltd. in China. It is understood that the UK, Italy, and Germany that Ericsson filed a lawsuit with ZTE are precisely the areas in which ZTE Terminal sells the most in Europe. In terms of LTE, ZTE has signed agreements for the construction of the LTE commercial trial network in Germany, Hungary, and local operators. In France, ZTE sold 2 million mobile phones in 2010. In 2011, ZTE aims to sell 3 million mobile phones.

The European businesses of Huawei and ZTE have grown rapidly in recent years. The data card products of the two companies have occupied the vast majority of the European market. Both companies’ executives also said this year that the European market is the focus of their development strategy.

In response, some analysts pointed out that Huawei's prosecution of ZTE, to a certain extent, reflects the increasing competition among international telecommunication equipment manufacturers in the next-generation communications network.
